THE PARTIES AGREE THAT THIS AGREEMENT, ANY SALES THERE UNDER, OR ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PREEXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, COMMON LAW, AND EQUITABLE CLAIMS) BETWEEN CUSTOMER AND TRAVELPOINT TOURS GMBH arising from or relating to this agreement, its interpretation, or the breach, termination or validity thereof, the relationships which result from this agreement, TRAVELPOINT TOURS GMBH's advertising, or any related purchase SHALL BE GOVERNED BY THE LAWS OF GERMANY, WITHOUT REGARD TO CONFLICTS OF LAWS RULES.
6. All products, tours and services offered by Travelpoint Tours GmbH are valid as per the dates displayed at http://www.BerlinFahrradverleih.com or any affiliated website. Travelpoint Tours GmbH is not responsible or liable for any information that it does not directly provide.
7. If you request a date change within three (3) days or less of your confirmed tour date, TRAVELPOINT TOURS GMBH will attempt to honor your request; however any changes made within 72 hours of your scheduled tour may attract an additional fee. There are no refunds offered within three (3) days of the scheduled tour for any reason.
8. Prices listed on http://www.BerlinFahrradverleih.com or affiliated websites are per person, unless otherwise specified. Prices are based on the local tariff at the time of quoting, converted at the prevailing foreign-exchange rate as determined by Travelpoint Tours GmbH.
9. Travelpoint Tours GmbH accepts the following credit cards: Mastercard and Visa.
- There is no charge or service fee for processing credit-card payments.
- Full payment by credit card is required to make a reservation.
- No refunds are available once a tour or service has commenced, or in respect of any package, accommodation, meals or any other services utilized.
SPECIAL NOTES AND CANCELLATION POLICY

Fat Tire Bike Rentals offers 100% refunds if the reservation is cancelled more than 72 hours (3 days) prior to the scheduled rental.
Fat Tire Bike Rentals does not offer refunds for any reason once within 72 hours of the scheduled rental.

THE PARTIES AGREE THAT THIS AGREEMENT, ANY SALES THERE UNDER, OR ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PREEXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, COMMON LAW, AND EQUITABLE CLAIMS) BETWEEN CUSTOMER AND TRAVELPOINT TOURS GMBH arising from or relating to this agreement, its interpretation, or the breach, termination or validity thereof, the relationships which result from this agreement, TRAVELPOINT TOURS GMBH's advertising, or any related purchase SHALL BE GOVERNED BY THE LAWS OF GERMANY, WITHOUT REGARD TO CONFLICTS OF LAWS RULES.
6. All products, tours and services offered by Travelpoint Tours GmbH are valid as per the dates displayed at http://www.BerlinFahrradverleih.com or any affiliated website. Travelpoint Tours GmbH is not responsible or liable for any information that it does not directly provide.
7. If you request a date change within three (3) days or less of your confirmed tour date, TRAVELPOINT TOURS GMBH will attempt to honor your request; however any changes made within 72 hours of your scheduled tour may attract an additional fee. There are no refunds offered within three (3) days of the scheduled tour for any reason.
8. Prices listed on http://www.BerlinFahrradverleih.com or affiliated websites are per person, unless otherwise specified. Prices are based on the local tariff at the time of quoting, converted at the prevailing foreign-exchange rate as determined by Travelpoint Tours GmbH.
9. Travelpoint Tours GmbH accepts the following credit cards: Mastercard and Visa.
- There is no charge or service fee for processing credit-card payments.
- Full payment by credit card is required to make a reservation.
- No refunds are available once a tour or service has commenced, or in respect of any package, accommodation, meals or any other services utilized.

2. Wenn nicht anders mit der Travelpoint Tours GmbH vereinbart, müssen Zahlungen für Reservierungen vor der Beginn der Tour abgeschlossen sein. Die Zahlung eines Produktes kann entweder wahlweise per Kreditkarte, per Banküberweisung, per Online-Überweisung oder mit einer im Vorfeld vereinbarten Zahlungsmethode erfolgen.
3. a) Die Haftung der Travelpoint Tours GmbH ist ausgeschlossen, soweit dies nicht in den folgenden Vorschriften anders geregelt ist.
b) Der Haftungsausschluss nach lit. a. gilt nicht für Schäden, die durch schuldhafte Verletzung einer wesentlichen Vertragspflicht in einer das Erreichen des Vertragszwecks gefährdenden Weise verursacht wurden. Wesentliche Vertragspflichten sind solche Pflichten, deren Erfüllung die ordnungsgemäße Durchführung des Vertrags überhaupt erst ermöglicht und auf deren Einhaltung der Vertragspartner regelmäßig vertraut und vertrauen darf. Die Haftung ist dabei jedoch auf den vertragstypischen Schaden begrenzt, mit dessen Entstehen jede Vertragspartei aufgrund der ihr zu diesem Zeitpunkt bekannten Umstände rechnen musste.
c) Der Haftungsausschluss nach lit. a. gilt ferner nicht für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, die auf einer fahrlässigen Pflichtverletzung der Travelpoint Tours GmbH oder ihrer gesetzlichen Vertreter oder Erfüllungsgehilfen beruhen.
d) Der Haftungsausschluss nach lit. a. gilt nicht für Schäden, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung der Travelpoint Tours GmbH oder ihrer gesetzlichen Vertreter oder Erfüllungsgehilfen beruhen.
e) Der Haftungsausschluss nach lit. a. gilt nicht gegenüber Ansprüchen aus dem Produkthaftungsgesetz.
f) Soweit die Haftung der Travelpoint Tours GmbH ausgeschlossen oder beschränkt ist, gilt dies auch für die Haftung der gesetzlichen Vertreter, Mitarbeiter und Erfüllungsgehilfen der Travelpoint Tours GmbH.

Hiermit bestätigen Sie, dass Sie ausschließlich für eigene und persönliche Zwecke buchen und bezahlen und nicht als Teil eines Geschäftes oder Vertrages mit dritten, um mit oder ohne Gewinn weiterverkauft zu werden. Die Travelpoint Tours GmbH schreibt für den Weiterverkauf von Dienstleistungen durch Dritte, gesonderte Geschäftsbedingungen vor.

Getätigte Änderungen innerhalb des 72-stündigen Zeitrahmens können jedoch unter Umständen Mehrkosten verursachen. Innerhalb des 72-stündigen Zeitrahmens werden unter keinen Umständen Rückzahlungen der getätigten Vorauszahlungen gewährt werden.
